These Terms of Service ("Terms") govern your use of the Wabisites website (wabisites.com) and any web design, hosting, and digital marketing services ("Services") provided by Wabisites ("we," "us," "our"). By using our website or purchasing Services, you agree to these Terms.

1. Services

Wabisites provides website design, development, hosting, maintenance, local SEO, and related digital marketing services for home service contractors and small businesses. Services are delivered according to the plan selected (Foundation, Growth, or Dominate) and the terms outlined in your service agreement.

2. Pricing and Payment

All plans are billed monthly with $0 upfront. Payments are processed automatically via Stripe on the same date each month. All prices are in USD.

• Foundation: $297/month
• Growth: $497/month
• Dominate: $797/month

Prepay discounts: 6-month prepay receives 1 month free. Annual prepay receives 2 months free.

3. Minimum Commitment

All plans require a 6-month minimum commitment. After the initial 6 months, your plan continues on a month-to-month basis. Cancellation requires 30 days written notice.

4. Early Termination

If you cancel before completing the 6-month minimum, the remaining months of the minimum term are due as an early termination fee. To receive your website files upon early termination, you must pay the termination fee in full.

5. Website Ownership

Wabisites owns and hosts your website for the first 12 months of continuous service. After 12 months of continuous payment, full ownership of the website design and content transfers to you. You own your domain name at all times. You are responsible for purchasing and maintaining your domain registration.

6. Hosting

Your website is hosted on Wabisites infrastructure (Vercel). You point your domain to our hosting. Hosting is included in all plans for the duration of your subscription.

7. Revisions and Updates

All plans include unlimited small changes (text updates, image swaps, minor adjustments). Full page redesigns or new page additions beyond your plan's scope may be quoted separately as change orders.

8. Client Responsibilities

You are responsible for providing accurate business information, photos, and content for your website. You represent that you have the right to use all materials you provide. You are responsible for responding to communications in a timely manner during the onboarding and build process.

9. Portfolio Rights

Wabisites retains the right to display your completed website as a portfolio piece and case study on our website, social media, and marketing materials.

10. Limitation of Liability

Wabisites' total liability for any claims arising from Services is limited to the total amount you have paid to Wabisites in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost revenue or profits.

11. Confidentiality

We will protect your business information and not share it with third parties except as necessary to deliver Services (e.g., hosting providers, analytics tools).

12. Modifications

We may update these Terms from time to time. Changes will be posted on this page with an updated date. Continued use of our Services after changes constitutes acceptance.

3. Third-Party Services

We use the following third-party services to operate:

• Vercel for website hosting
• Stripe for payment processing
• GoHighLevel for appointment booking and CRM
• Google Analytics / PostHog for website analytics
• GoHighLevel for CRM and client communication

Each of these services has their own privacy policy. We only share the minimum information necessary for them to function.

4. Cookies

Our website may use cookies and similar technologies for analytics and functionality. You can control cookie preferences through your browser settings. Disabling cookies may limit some website features.

5. Data Security

We use industry-standard measures to protect your information, including encrypted connections (SSL/TLS) and secure payment processing through Stripe. No method of transmission over the internet is 100% secure, but we take reasonable steps to protect your data.

We retain your information for as long as your account is active or as needed to provide Services. If you cancel, we may retain certain information as required by law or for legitimate business purposes (e.g., billing records).
